Merritt Made Human Performance, LLC (“Merritt Made Human Performance,” “MMHP,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, store, and protect personal information when you:

  • Visit merrittmadehumanperformance.com;
  • Complete an application, assessment, questionnaire, or contact form;
  • Purchase or participate in our in-person or remote coaching services;
  • Use the Merritt Made Human Performance coaching application powered by Exercise.com;
  • Communicate with us by email, telephone, text message, video call, social media, or through a coaching platform; or
  • Otherwise interact with Merritt Made Human Performance.


By using our website or voluntarily providing information to us, you acknowledge the practices described in this Privacy Policy.


1. Information We Collect

Depending on how you interact with Merritt Made Human Performance, we may collect the following categories of information.


Contact and Account Information

Health and Readiness Information

To help us evaluate exercise readiness and provide appropriate coaching, we may collect information concerning:

  • Injuries, pain, physical limitations, and previous surgeries;
  • Medical conditions relevant to exercise participation;
  • Medications that may affect exercise, when voluntarily disclosed;
  • Physician recommendations or exercise restrictions;
  • Lifestyle, sleep, recovery, stress, or nutrition information;
  • Physical Activity Readiness Questionnaire responses;
  • Health-history assessment responses; and
  • Medical or professional clearance documentation when appropriate.

Please provide only information that is reasonably relevant to your safe participation in coaching.


Communications and Media

We may collect:

  • Emails, text messages, direct messages, and coaching-platform messages;
  • Notes from telephone or video conversations;
  • Exercise videos, progress photos, movement assessments, and other media you submit;
  • Testimonials or feedback you voluntarily provide; and
  • Records of customer-service or coaching interactions.

Transaction Information

When you purchase a service, we may collect:

  • The service or package selected;
  • Transaction date and amount;
  • Payment and subscription status;
  • Billing history;
  • Discounts, refunds, or credits; and
  • Limited payment-related information supplied by our payment provider.

Full payment-card information is generally collected and processed by third-party payment processors rather than stored directly by Merritt Made Human Performance.

  • Review applications and determine whether our services may be appropriate;

  • Design, deliver, monitor, and modify individualized training programs;
  • Evaluate exercise readiness and identify when medical clearance may be appropriate;
  • Track progress, adherence, performance, and coaching outcomes;
  • Communicate about programs, check-ins, scheduling, payments, and account matters;
  • Provide customer service and respond to questions;
  • Process payments, renewals, cancellations, and refunds;
  • Maintain business, tax, insurance, and transaction records;
  • Improve our coaching services, website, client experience, and business operations;
  • Protect clients, MMHP, and others from fraud, misuse, or safety threats;
  • Send promotional communications when permitted;
  • Enforce our contracts, policies, and legal rights; and
  • Comply with applicable laws, regulations, court orders, or legal processes.

We may also use information that has been aggregated or reasonably de-identified for business analysis and service improvement.


4. Health and Fitness Information

Health, injury, and fitness information may be used to personalize coaching, evaluate exercise readiness, modify exercise recommendations, and support client safety.

Merritt Made Human Performance provides fitness and performance coaching—not medical diagnosis, treatment, physical therapy, or emergency medical services. Unless we expressly notify you otherwise, MMHP is not acting as a healthcare provider or health plan covered by the Health Insurance Portability and Accountability Act, commonly known as HIPAA. Information submitted to MMHP may therefore not receive the same protections as information held by a HIPAA-covered healthcare provider.

We do not use client health information for third-party advertising. We may disclose relevant information to a healthcare or allied professional when you request or authorize us to do so, or when disclosure is otherwise permitted or required by law.


5. How We Disclose Information

We may disclose personal information in the following circumstances.


Coaching and Business Service Providers

We may provide information to companies that help us operate our business and deliver services, including:

  • Exercise.com and its affiliated companies, including Daxko;
  • Website hosting providers such as GoDaddy;
  • Payment processors;
  • Email, telephone, text-messaging, and video-conferencing providers;
  • Scheduling, document-storage, and administrative software providers;
  • Analytics or advertising providers, if those services are enabled;
  • Accountants, attorneys, insurers, and other professional advisers; and
  • Contractors or coaches assisting MMHP with an authorized service.

These providers may access information only as needed to perform their functions or as otherwise described in their respective privacy policies.


At Your Direction

We may disclose information when you ask or authorize us to communicate with a parent, guardian, coach, physician, physical therapist, athletic trainer, or another professional.


Legal, Safety, and Business Purposes

We may disclose information when we reasonably believe it is necessary to:

  • Comply with applicable law, a subpoena, court order, or governmental request;
  • Protect the rights, safety, and property of a client, MMHP, or another person;
  • Investigate suspected fraud, abuse, or violations of our agreements;
  • Establish, exercise, or defend a legal claim; or
  • Complete a merger, acquisition, financing, reorganization, or transfer of business assets, subject to appropriate privacy protections.


6. Sale and Advertising-Related Sharing

Merritt Made Human Performance does not sell personal information in exchange for money.


If MMHP uses analytics pixels, advertising cookies, or similar technologies, information about website activity may be disclosed to advertising or analytics providers. Certain state laws may define some of these disclosures as “selling,” “sharing,” or targeted advertising even when no money is exchanged.


Where applicable, you may request to opt out of advertising-related sharing by contacting us or using the cookie and tracking controls made available on our website.

We do not disclose health-history responses, exercise-readiness information, private coaching communications, or client-submitted progress media to third-party advertisers.


7. Payments

Payments may be processed through Exercise.com, Daxko, or another third-party payment processor. Payment providers may collect payment-card and billing information under their own privacy policies and security practices.


Merritt Made Human Performance generally receives transaction records and payment status rather than retaining complete payment-card numbers. You should review the privacy policy presented by the applicable payment provider.


8. Email and Text Communications

We may use email or text messaging for:

  • Coaching communication;
  • Check-in reminders;
  • Scheduling and account updates;
  • Payment or subscription notices;
  • Customer support; and
  • Promotional information when permitted.

You may unsubscribe from promotional emails by using the unsubscribe link, when available, or by contacting us. You may opt out of promotional text messages by replying “STOP,” when that functionality is available, or by contacting us directly.


Opting out of promotional messages does not prevent us from sending non-promotional messages reasonably necessary to administer an active service, transaction, or account.

Mobile telephone information and text-message opt-in consent will not be sold or provided to unaffiliated third parties for their own marketing. We may provide this information to vendors that help us deliver our communications.


9. Photos, Videos, Testimonials, and Client Results

Photos, exercise videos, and other media submitted for coaching may be reviewed and stored as necessary to deliver services.


Submission of media for coaching does not automatically authorize MMHP to use that media publicly. We will obtain separate permission before using an identifiable client’s image, video, testimonial, name, or results in advertising, social media, case studies, or other public promotional materials.


You may withdraw future promotional permission by contacting us. Withdrawal will not necessarily require MMHP to recall materials already lawfully published or distributed before the withdrawal.


10. Cookies, Analytics, and Embedded Content

Our website and its service providers may use cookies and similar technologies to:

  • Enable website functionality;
  • Maintain security;
  • Remember visitor preferences;
  • Understand website traffic and performance;
  • Measure marketing effectiveness; and
  • Provide or measure relevant advertising, if enabled.

12. Children and Youth Athletes

Our website and online forms are not intended to be completed independently by children under 18.


If a participant is under 18, a parent or legal guardian must communicate with MMHP, provide the participant’s information, manage the participant’s account, and complete all required agreements and authorizations. We do not knowingly collect personal information online directly from a child under 13 without appropriate parental involvement or consent.


Clients under 18 must have a parent or legal guardian authorize participation and complete required contracts, waivers, and health forms unless applicable law provides otherwise.

If you believe a child has submitted information without appropriate parental permission, contact us so that we can review and, when appropriate, delete it.


13. Data Retention

We retain personal information for as long as reasonably necessary to:

  • Deliver and administer services;
  • Maintain appropriate coaching, safety, and transaction records;
  • Fulfill the purposes described in this policy;
  • Meet tax, accounting, insurance, and legal obligations;
  • Resolve disputes; and
  • Enforce agreements.


Retention periods may vary based on the type of information, the client’s age, the length of the coaching relationship, and applicable legal requirements.

When information is no longer reasonably necessary, we may delete, de-identify, or securely dispose of it. Information may remain temporarily in backups or records that we are legally required to retain.


14. Information Security

We use reasonable administrative, technical, and organizational measures intended to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure.


However, no website, application, communication method, or electronic storage system is completely secure. We cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your login credentials and notifying us if you believe your account has been compromised.


Please do not send highly sensitive or urgent medical information through ordinary email or text messaging.


15. Your Choices and Privacy Rights

Depending on where you live and subject to applicable law, you may have the right to request that we:

  • Confirm whether we maintain personal information about you;
  • Provide access to certain personal information;
  • Correct inaccurate information;
  • Delete certain information;
